Environmental Authorisations
The National Environmental Management Act, 1998 (Act No. 107 of 1998, abbreviated NEMA) is the statutory framework to enforce Section 24 of the Constitution of the Republic of South Africa. The NEMA is intended to promote co-operative governance and ensure that the rights of people are upheld, but also recognising the necessity of economic development. NEMA supersedes the Environmental Conservation Act, which was inadequate to deal with enforcement, administration, and governance, and was written to be more successful in these aspects.
The purpose of NEMA is to provide for co-operative, environmental governance by establishing principles for decision-making on matters that affecting the environment, institutions will promote co-operative governance and procedures for co-ordinating environmental functions exercised by organs of state; and to provide for matters connected therewith.
During the planning stage of a development, EarthWorth will assist clients with the identification of environmental opportunities as well as the risks associated with proposed developments. Relevant specialists will be consulted to determine the viability of the proposed development and provide alternatives, where required. EarthWorth will indicate if any Listed Activities [activities as identified under Sections 24, 24(D) and 24(O) of the National Environmental Management Act, 1998 (Act No 107 of 1998)] are triggered by the proposed development. In such a case, an application for Environmental Authorisation should be submitted by our company to the Competent Authority.
Listed Activities are activities that may result in substantial negative impacts on the environment. These regulations require(d) that an environmental impact assessment process be followed in respect of these identified activities and applications be submitted to the competent authority for consideration. This process requires public notification and participation, consideration of the potential environmental impacts of the activity, assessment of possible mitigation measures, and an assessment of whether there are any significant issues or impacts that might require further investigation.

PROPOSED CONSTRUCTION OF A PIPELINE FOR THE TRANSPORTATION OF WATER, POSTDENE, POSTMASBURG
The proposed construction activities will be undertaken on Erf 2587, South of Jakaranda Avenue and Iris Way, Postdene, Postmasburg.
The project aims to improve the water supply and pressure in the Postdene area of Postmasburg. A new 1 800 m HDPE pipeline with diameter of 355 mm is to be installed adjacent to the railway line connecting two parts of the network. The project will entail the trench excavation, laying of the pipeline, construction of valve chambers and connecting to existing pipes on either end.
The project will form part of the bulk water supply of Postmasburg, Tsantsabane Local Municipality.

Basic Assessments
This process is followed if activities form Listing Notice 1 or Listing Notice 3 of NEMA will be triggered. These are usually smaller scale activities, and the impacts can be managed.
Example:
The development and related operation of facilities or infrastructure for the generation of electricity from a non-renewable resource where—
(i) the electricity output is more than 10 megawatts but less than 20 megawatts;
or (ii) the output is 10 megawatts or less but the total extent of the facility covers an area in excess of 1 hectare.
Full EIA's
This process is followed if activities from Listing Notice 2 of NEMA is triggered. These activities are likely to have a significant impact on the environment. A higher risk for pollution, waste and environmental degradation is also associated with these projects.
Example:
The development and related operation of facilities or infrastructure for the generation of electricity from a non-renewable resource where the electricity output is 20 megawatts or more.
Mining Applications
A mining permit gives a company or individual permission to mine a small area of land (not more than 1.5 hectares) for a specified period of up to 2 years. A mining right on the other hand, gives a company or an individual permission to mine for a specified period of up to 30 years. Please contact us should you wish to apply for a mining permit / right.
Environmental Audits/Monitoring
We are experienced in carrying out monitoring / audits for construction / mining related activities. In addition, our team has a broad knowledge in the compilation of Environmental Management Plans associated with the construction phase of various projects.
Atmospheric Emission Applications
Applications should be submitted in accordance with the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004), as amended (NEM: AQA).
Applications should be submitted in accordance with the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) (NEM: WA)
Water Use Authorisations
The National Water Act, 1998 (Act No. 36 of 1998) is applicable to these applications.

Public Participation and Stakeholder Engagement
The right of access to environmental information is a cornerstone of public participation in environmental governance. It is vital that people be informed as to the state of the environment and of issues which may affect the environment in order that their participation is meaningful. We carry out the Public Participation Processes for the projects that we are involved with.
Retrospective Damage Assessments (Section 24G Applications)
We have undertaken applications for environmental authorisations for Listed Activities that commenced illegally through the Section 24G Application Process.
